These Terms of Service ("Terms") form a binding agreement between you ("you," "Customer," or "Sender") and Party Plug LLC dba Courier Service Las Vegas ("we," "us," or "Company") and govern your access to our website and your use of our courier, same-day, rush, medical, legal, scheduled-route, and related delivery services (collectively, the "Services"). By accessing our website, requesting a quote, or booking a delivery, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility & Acceptance
You must be at least 18 years old and able to form a binding contract to use the Services. By booking a delivery on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms. Your continued use of the Services constitutes ongoing acceptance of these Terms and any posted policies referenced here, including our Terms & Conditions of Carriage, Privacy Policy, and SMS Terms.
2. Description of Services
We provide local courier and logistics services within the Las Vegas Valley and surrounding areas of Clark County, Nevada, including same-day, rush/on-demand, medical and lab specimen, legal document, scheduled-route, and warehousing/distribution deliveries. Service availability, timing, and coverage are estimates and may vary based on demand, traffic, weather, driver availability, and other factors. Quoted delivery windows are good-faith estimates and are not guaranteed unless expressly agreed in writing.
3. Booking, Quotes & Account Information
When you request a quote or place an order, you agree to provide accurate, current, and complete pickup and delivery addresses, contact details, package descriptions, and special instructions. You are responsible for the accuracy of all information you provide. Quotes are based on the information supplied and may be adjusted if actual distance, weight, dimensions, wait time, access conditions, or service level differ from what was provided.
4. Pricing & Payment
Prices are quoted before booking and are based on distance, package size and weight, service level, and timing. Additional charges may apply for wait time, redelivery, address corrections, after-hours service, oversized items, tolls, or special handling. Unless otherwise agreed, payment is due upon completion of the delivery or per the terms of your account or invoice. Late or unpaid balances may be subject to a finance charge and collection costs as permitted by Nevada law.
5. Cancellations, Changes & Refunds
You may cancel or modify an order before a driver has been dispatched at no charge. Once a driver has been dispatched or has arrived at the pickup location, a cancellation or "dry run" fee may apply to cover the cost of the trip. Refunds, where applicable, are issued at our discretion based on the circumstances and the stage of the delivery. Completed deliveries are generally non-refundable.
6. Customer Responsibilities
You are responsible for properly packaging and labeling all items, ensuring that someone is available to release the item at pickup and receive it at delivery, and obtaining any permits, authorizations, or recipient consents required. You must not tender any item that is prohibited or restricted under our Terms & Conditions of Carriage or applicable law.
7. Prohibited & Restricted Items
Certain items may not be shipped through our Services. A non-exhaustive list of prohibited and restricted items, along with declared-value and handling rules, is set out in our Terms & Conditions of Carriage, which is incorporated into these Terms by reference. Tendering a prohibited item is a breach of these Terms and may result in refusal, additional charges, and liability for any resulting loss or damage.
8. Right to Refuse Service
We may refuse, hold, or return any shipment, and may decline or terminate service to any person, at our discretion, including where a shipment is improperly packaged, appears to contain a prohibited item, poses a safety or legal risk, or where payment terms are not met. We are not liable for any loss arising from a lawful refusal of service.
9. Limitation of Liability
To the maximum extent permitted by law, our liability for loss of or damage to any shipment is limited as described in our Terms & Conditions of Carriage. In no event will we be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost business, or lost data, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Services will not exceed the greater of the amount you paid for the specific delivery at issue or the applicable carriage liability limit.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, drivers, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your shipment of prohibited or improperly declared items, or your violation of any law or the rights of a third party.
11. Disclaimer of Warranties
The Services and our website are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services or website will be uninterrupted, timely, secure, or error-free.
12. Intellectual Property
All content on our website, including text, graphics, logos, and the Courier Service Las Vegas name and marks, is owned by or licensed to the Company and protected by intellectual-property laws. You may not copy, reproduce, or use our content or marks without our prior written permission.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Except where prohibited, any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. You and the Company agree that any dispute will be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
14. Changes to These Terms
We may revise these Terms at any time by posting an updated version on our website. Changes are effective when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
