These Terms & Conditions of Carriage ("Conditions") apply to every shipment tendered to Courier Service Las Vegas and supplement our Terms of Service. By tendering a shipment, you accept these Conditions on behalf of yourself and any other party with an interest in the shipment.
1. Definitions
"Shipment" means any item or items tendered to us for delivery under a single order. "Sender" means the party that tenders a shipment. "Declared Value" means the value the Sender assigns to a shipment for liability purposes, subject to these Conditions. "Proof of Delivery" means our record (which may include a photo, signature, or timestamp) confirming delivery.
2. Limitation of Liability & Declared Value
Unless a higher Declared Value is requested and accepted in writing before pickup and any applicable fee is paid, our maximum liability for loss of or damage to a shipment is limited to the lesser of the actual value of the goods or USD $100 per shipment. The Sender may declare a higher value, up to limits we accept, by requesting it at the time of booking and paying the corresponding valuation charge; declaring a higher value is not the purchase of insurance. We are not liable for loss or damage that exceeds the Declared Value, nor for any item of "extraordinary value" (see Section 5) unless expressly agreed in writing.
3. Claims Procedure & Deadlines
All claims for loss, damage, or delay must be submitted in writing. Visible loss or damage must be noted at the time of delivery and reported within fifteen (15) calendar days of the delivery date. Concealed damage must be reported within forty-eight (48) hours of delivery. Failure to report within these periods waives the claim.
A valid claim must include the order details, proof of value (such as an invoice), a description of the loss or damage, and supporting photographs where applicable. We may inspect the shipment and packaging. No claim will be paid while any amount owed for the shipment remains unpaid. Any legal action relating to a shipment must be commenced within one (1) year of the delivery date or scheduled delivery date.
4. Prohibited Items
The following items may not be tendered for carriage:
- Cash, coins, bullion, negotiable instruments in bearer form, and gift cards
- Firearms, ammunition, explosives, and weapons
- Illegal drugs and controlled substances (except lawful medical/pharmacy deliveries arranged under a compliant agreement)
- Hazardous, flammable, toxic, radioactive, or biohazardous materials not properly documented and accepted
- Live animals and perishable goods not pre-approved for handling
- Human remains
- Stolen, counterfeit, or unlawful goods
- Any item the carriage of which would violate applicable law
5. Restricted & Extraordinary-Value Items
Items of extraordinary value—including jewelry, precious metals and stones, fine art, antiques, original documents that cannot be replaced, prototypes, and high-value electronics—are carried only by prior written agreement and remain subject to the liability limits in Section 2 unless a higher Declared Value is accepted. Medical and lab specimens, pharmaceuticals, and legal documents are carried subject to the special-handling terms in Sections 8 and 9.
6. Packaging & Labeling
The Sender is responsible for packaging each shipment adequately to protect the contents and to withstand ordinary handling and transport. Shipments must be clearly labeled with accurate pickup and delivery information. We are not liable for loss or damage caused by inadequate or improper packaging, mislabeling, or the inherent nature or defect of the goods.
7. Delivery, Proof of Delivery & Undeliverable Shipments
We deliver to the address provided by the Sender. A delivery is complete when the shipment is left with the recipient, with a person reasonably appearing to be authorized to receive it, or at the location designated by the Sender, and is evidenced by our Proof of Delivery. If a shipment cannot be delivered—for example, the recipient is unavailable, refuses the item, or the address is incorrect—we will attempt to contact the Sender and may charge for storage, redelivery, or return.
8. Medical, Lab Specimen & HIPAA Shipments
Medical and laboratory shipments are handled under chain-of-custody procedures and, where applicable, in a HIPAA-compliant manner pursuant to a Business Associate Agreement or other written arrangement with the healthcare client. The Sender is responsible for proper containment, labeling, and any temperature or biohazard requirements, and for ensuring the shipment complies with all applicable health and safety regulations.
9. Delays, Force Majeure & Service Interruptions
Delivery times are estimates and are not guaranteed unless a guaranteed window is agreed in writing. We are not liable for delays or failure to perform caused by events beyond our reasonable control, including traffic, accidents, road or weather conditions, natural disasters, acts of God, strikes or labor disputes, civil or governmental action, network or equipment failures, or other force-majeure events.
10. Insurance
We maintain commercial liability and auto coverage as required by law. Our coverage is not cargo insurance for the benefit of the Sender. If you require coverage above the Declared-Value limits in these Conditions, you should obtain your own shipment insurance.
11. Governing Law
These Conditions are governed by the laws of the State of Nevada and, where applicable, federal law. To the extent any provision conflicts with a mandatory rule of law, that provision will be modified only to the minimum extent necessary, and the remaining provisions will remain in effect.
